The most unconstitutional action taken by Trump is outlined as follows.



On his first day in office, President Donald Trump enacted a series of executive orders. Some of these orders are trivial, such as his request to rename the Gulf of Mexico to “Gulf of America.” Others, however, are more concerning, particularly his initiative to significantly increase the number of federal civil servants who can be dismissed at will. Many of these orders aim to enforce the stringent immigration policies central to Trump’s political agenda. 

The most alarming of these immigration-related orders attempts to revoke citizenship from millions of potential future Americans. There is no debate regarding the constitutionality of these orders; the Constitution explicitly states that all individuals born in the United States and subject to its jurisdiction are citizens, irrespective of their parents’ immigration status. This principle has been upheld by the Supreme Court for over 125 years.

Trump’s order, titled “Preserving the Meaning and Value of American Citizenship,” aims to deny citizenship to two specific groups. The first group includes children born to mothers who are not legally recognized, where the father is neither a citizen nor a lawful permanent resident at the time of birth. The second group consists of children whose fathers share the same immigration status, and whose mothers were legally but temporarily present in the United States during their birth. Almost immediately following the issuance of this executive order, pro-immigration advocates began highlighting notable Americans who would lose their citizenship if the order were enacted at birth, including former Vice President Kamala Harris. However, it is important to note that the order does not affect current U.S. citizens and is not retroactive; it only seeks to revoke citizenship from “persons born within the United States after 30 days from the date of issuance of this order.” 

It is anticipated that immigration advocates will soon secure a court order to block Trump’s executive order, as a coalition of civil rights organizations, including the ACLU, has already initiated a lawsuit to seek such an injunction. Furthermore, the Supreme Court has previously ruled on this matter.
